Pre-Shipment Information and Customer Cooperation
International transportation may require certain information, documentation, confirmations, or regulatory arrangements to be completed before Products can be released or dispatched for transportation.
Depending on the destination country, transportation method, shipment configuration, or applicable regulatory requirements, BaliSouk or a party involved in the shipment may request Personal Data reasonably necessary to identify the Customer, Consignee, Importer, Importer of Record, ISF Importer, customs broker, authorized representative, receiver, or other relevant party.
Such information may include contact details, identification information, importer or customs identification numbers, broker details, powers of attorney or authorization information, customs-bond information, consignee information, shipping instructions, and other information reasonably required for transportation, customs, import, regulatory, cargo-release, or related procedures.
BaliSouk may retain records showing whether and when such information or documentation was requested, provided, corrected, completed, confirmed, declined, or refused, where reasonably necessary for order administration, shipment coordination, compliance, fraud prevention, dispute management, recovery of amounts lawfully due, or the establishment, exercise, or defence of legal rights.
International Shipping and Logistics Data
Because BaliSouk Products are shipped internationally from Bali, Indonesia, fulfilment of an order may require Personal Data to be included in or transmitted through international transportation and customs documentation.
The Customer acknowledges that information such as the Customer's or Consignee's name, address, telephone number, email address, shipping destination, order information, cargo description, importer information, identification or registration information where required, and other information required for transportation or customs purposes may need to be provided to parties involved in the international shipment.
Such information may appear, where necessary, on Bills of Lading, Sea Waybills, air waybills, commercial invoices, packing lists, arrival notices, customs documents, certificates, cargo-release documentation, regulatory filings, or other transportation and import-related records.
Personal Data reasonably necessary for international transportation may be transmitted between countries through the international freight and customs network and may therefore be processed in Indonesia, transit countries, the destination country, or other locations involved in transportation or customs processing.
Where a shipment becomes subject to storage, customs hold, non-collection, refusal, abandonment, disposal, return, re-routing, recovery, insurance, or other post-shipment procedures, relevant Personal Data may continue to be processed and exchanged between parties reasonably involved in resolving the shipment.
Customs, Import and ISF Information
For international shipments, BaliSouk may provide Personal Data and shipment information reasonably required by customs authorities, freight forwarders, customs brokers, carriers, destination agents, logistics coordinators, or other authorized parties for customs clearance, import procedures, cargo release, regulatory compliance, or related formalities.
For ocean freight shipments to the United States, information reasonably required to enable the applicable ISF Importer or its authorized customs broker or filing agent to complete an Importer Security Filing may be communicated to the relevant parties.
Such information may include information concerning the Customer, purchaser, Consignee, owner, Importer of Record, ISF Importer, manufacturer, seller, shipment, cargo, transportation arrangements, or other information required under applicable customs or transportation procedures.
Providing information for these purposes does not mean that BaliSouk acts as the Customer's customs broker, Importer of Record, ISF Importer, or authorized filing agent unless BaliSouk has expressly agreed otherwise in writing.
Data Sharing and Disclosure
BaliSouk may disclose Personal Data to third parties where reasonably necessary for an order, service, international shipment, pre-shipment requirement, destination procedure, payment, legal obligation, legitimate business purpose, recovery process, dispute, or other lawful processing purpose.

BaliSouk may use independent or affiliated service providers to perform logistics, transportation coordination, administrative, technology, payment, fulfilment, compliance, recovery, professional, or other services connected with an order. Personal Data may be disclosed to such providers only to the extent reasonably necessary for the relevant service or other lawful purpose.
BaliSouk does not sell Personal Data for monetary consideration. Where applicable privacy law gives a broader legal meaning to the terms “sale” or “sharing,” BaliSouk will comply with any disclosure, consent, or opt-out requirements applicable to the relevant processing activity.
Payment Disputes, Chargebacks, Recovery and Legal Claims
BaliSouk may retain and use information reasonably necessary to establish the history, contractual basis, payment history, fulfilment, transportation, and performance of an order and to prevent or respond to fraud, complaints, payment disputes, bank recalls, payment reversals, chargebacks, insurance claims, contractual disputes, debt-recovery matters, or legal proceedings.
Such information may include order confirmations, quotations, invoices, evidence of acceptance of applicable policies, payment records, production records, Product photographs, videos, quality-control records, packing documentation, correspondence, emails, messages, Customer instructions, shipping documents, Bills of Lading, tracking or vessel information, customs communications, destination-agent communications, cargo-release information, delivery or collection notices, pre-shipment requests and responses, importer or broker information, storage or abandonment records, third-party invoices, and records concerning the Customer's instructions, actions, cooperation, non-cooperation, refusal, silence, payment conduct, or failure to complete applicable pre-shipment or destination procedures.
Where reasonably necessary and permitted by applicable law, BaliSouk may use such information to establish the validity of an order, demonstrate performance, respond to allegations or disputes, contest or respond to a chargeback or payment reversal, substantiate amounts lawfully due, document additional costs, preserve evidence, mitigate losses, recover amounts lawfully due, or establish, exercise, enforce, or defend contractual or legal rights.
Where reasonably necessary for these purposes, relevant information may be disclosed to payment providers, banks, acquiring institutions, issuing banks, card networks, financial institutions, insurers, professional advisers, collection providers, legal representatives, dispute-resolution bodies, courts, tribunals, regulators, enforcement professionals, or other parties responsible for investigating, administering, determining, enforcing, or resolving the applicable claim or dispute.
The fact that a Customer initiates a payment dispute, bank recall, chargeback, payment reversal, complaint, or legal claim does not require BaliSouk to delete or cease processing Personal Data that BaliSouk remains legally entitled or required to retain or process for fraud prevention, evidence preservation, contractual administration, dispute resolution, accounting, tax, customs, insurance, recovery, or the establishment, exercise, or defence of legal rights.
Preservation of Evidence
Where BaliSouk reasonably anticipates or becomes aware of a payment dispute, chargeback, contractual dispute, customs dispute, transportation claim, insurance claim, recovery matter, threatened proceeding, legal claim, or other dispute, BaliSouk may preserve relevant Personal Data and records for the period reasonably necessary to investigate, administer, resolve, establish, exercise, enforce, or defend the relevant rights or claims, subject to applicable law.
Such preservation may apply notwithstanding a deletion request where applicable law permits or requires continued retention for the establishment, exercise, or defence of legal claims, compliance with legal obligations, fraud prevention, or other lawful purposes.
Legal Bases for Processing
Depending on the applicable data-protection law and the relevant processing activity, BaliSouk may process Personal Data where processing is necessary to perform a contract with the Customer or take steps requested before entering into a contract; to comply with a legal obligation; for BaliSouk's legitimate interests or those of a third party where such interests are not overridden by applicable data-protection rights; for the establishment, exercise, or defence of legal claims where recognized by applicable law; or on the basis of consent where consent is required by applicable law.
Legitimate interests may include operating and protecting the business, administering orders, coordinating international transportation, administering pre-shipment and destination requirements, maintaining appropriate evidence concerning fulfilment and Customer instructions, preventing fraud, administering and defending payment disputes, maintaining transaction and shipping records, recovering amounts lawfully due, improving services, securing the website, protecting assets, mitigating losses, and establishing, exercising, enforcing, or defending legal claims.
International Data Transfers
Because BaliSouk operates internationally and ships Products worldwide from Indonesia, Personal Data may be transferred to and processed in countries other than the country in which the User resides.
These transfers may occur where necessary for e-commerce operations, payment processing, international transportation, pre-shipment procedures, customs clearance, importation, logistics, customer support, technology services, fraud prevention, dispute management, insurance, recovery, professional services, or legal compliance.
International freight transportation may involve multiple independent parties and jurisdictions, including Indonesia, transit countries, destination countries, carriers, freight forwarders, NVOCCs, logistics coordinators, customs brokers, destination agents, customs authorities, ports, terminals, warehouses, and other parties involved in the transportation or importation process.
Where applicable data-protection law requires specific safeguards for international transfers of Personal Data, BaliSouk will use appropriate safeguards or another legally permitted transfer mechanism as required by the applicable law.
Data Minimization
BaliSouk seeks to collect and process only Personal Data that is reasonably necessary, relevant, and proportionate for the applicable purpose.
Where identity documents, importer information, customs information, regulatory information, or other information is requested for a shipment, BaliSouk may limit the information requested or retained where the full document or full set of information is not reasonably necessary for the applicable transportation, customs, compliance, fraud-prevention, dispute-management, recovery, or legal purpose.
Data Retention
BaliSouk retains Personal Data for no longer than reasonably necessary for the purposes for which it was collected or subsequently lawfully processed, taking into account applicable legal, accounting, tax, customs, contractual, fraud-prevention, insurance, dispute-resolution, limitation-period, recovery, and recordkeeping requirements.
Order, payment, production, quality-control, shipping, customs, pre-shipment, correspondence, and transaction records may be retained after completion of an order where reasonably necessary to comply with legal obligations, maintain business and accounting records, respond to warranty or insurance matters, prevent fraud, administer payment disputes or chargebacks, recover amounts lawfully due, preserve evidence, or establish, exercise, enforce, or defend legal claims.
Where a dispute, chargeback, payment reversal, recovery action, insurance matter, investigation, threatened claim, or legal proceeding exists or may reasonably be anticipated, relevant records may be retained until the matter has been finally resolved and for any additional period reasonably necessary or required under applicable limitation, accounting, tax, regulatory, or legal requirements.
Identity documents, identification information, customs information, importer information, or similar Personal Data collected for transportation or regulatory purposes will not be retained longer than reasonably necessary for the applicable purpose, subject to any legal, customs, accounting, fraud-prevention, dispute-resolution, recovery, or legal-claim retention requirement.
Where Personal Data is no longer reasonably required and no legal or legitimate basis requires continued retention, it will be deleted, anonymized, or otherwise handled in accordance with applicable law.
Data Security
BaliSouk implements reasonable technical, organizational, and operational measures designed to protect Personal Data against unauthorized access, disclosure, alteration, loss, misuse, or destruction, taking into account the nature of the information and the circumstances of the processing.
Where identification documents, customs information, importer information, payment-dispute information, or other information of increased sensitivity is processed, BaliSouk seeks to limit access to persons and service providers who reasonably require such information for the relevant purpose.
However, no electronic transmission, information system, or storage method can be guaranteed to be completely secure, and BaliSouk cannot guarantee absolute security of information transmitted or stored electronically.
User Rights
Depending on the applicable jurisdiction, Users may have rights regarding their Personal Data, including the right to request access, correction, deletion, restriction of processing, objection to certain processing activities, or data portability, and the right to withdraw consent where processing is based on consent.
These rights may be subject to exceptions and limitations under applicable law. In particular, a deletion, restriction, or objection request does not necessarily require BaliSouk to delete, restrict, or cease processing information that it is legally required or otherwise lawfully entitled to retain or process, including information required for accounting, tax, customs, fraud-prevention, contractual administration, insurance, payment-dispute administration, chargeback defence, recovery, dispute-resolution, evidence preservation, or legal-claim purposes.
BaliSouk may request reasonable information necessary to verify the identity and authority of a person making a data-rights request before acting upon that request.
Requests relating to Personal Data rights may be submitted using the contact details below and will be handled in accordance with applicable law.
Cookies and Similar Technologies
The BaliSouk website may use cookies and similar technologies necessary for website functionality, account management, shopping-cart operation, checkout, security, fraud prevention, analytics, personalization, advertising, and measurement.
Where applicable law requires consent before non-essential cookies or similar technologies are used, such technologies will be subject to the applicable consent requirements and available preference controls.
Marketing Communications
Where permitted by applicable law, BaliSouk may use contact information to send marketing or promotional communications.
Where consent is required, such communications will be sent in accordance with the applicable consent requirements. Users may unsubscribe from marketing communications using the unsubscribe mechanism provided in the relevant communication or by contacting BaliSouk.
Unsubscribing from marketing communications does not prevent BaliSouk from sending transactional or service communications reasonably necessary for an existing order, payment, production, pre-shipment requirement, shipment, customs procedure, delivery, account, security matter, dispute, recovery matter, or legal obligation.
Minors
The BaliSouk website and services are not intended for minors. BaliSouk does not knowingly collect Personal Data from individuals under the age at which they may lawfully provide their own Personal Data for the relevant service under applicable law.
